On March 14, 2023, Senate Bill 56 the ACEC Ohio sponsored bill which regulates the use of indemnity provisions in contracts related to public improvements became effective and is now law in Ohio. What to do now? If your firm receives a contract from a public entity that contains a broad indemnification clause, let your client know that Ohio Revised Code 153.81 has been revised to limit the scope of indemnity provisions to what is reasonable and insurable.  Click here for the enacted bill language.

ACEC Ohio recommends working with your professional liability insurer or legal counsel if you have any concerns with indemnity language in a public improvement contract.
